These terms and conditions govern your use of this site, and constitute an agreement between you and Sellmalta Limited [C44591] (“Sellmalta”).  By using, viewing, transmitting, caching, storing and/or otherwise utilising this site, the services or functions offered hereon and/or the contents and information on this site, you agree to each and all of the terms and conditions set forth below, and waive any right to claim ambiguity or error in this Agreement.  Should you not agree to each and every term and condition set out herein, you are asked not to use the site and to leave immediately.  Periodic or continued users of this site are reminded that site usage following the posting of changes or amendments to this Agreement from time to time will imply that such changes or amendments are accepted by you.

1. Privacy Policy

We are committed to protecting our visitors’ privacy and we will not collect any personal information about you as a visitor unless you provide it voluntarily.  Any personal information you communicate to us is kept by Sellmalta itself in accordance with the Data Protection Act, 2001 (Chapter 440 of the Laws of Malta).

2. The Data Protection Act, 2001

The Data Protection Act, 2001 – Chapter 440 of the Laws of Malta – was enacted on the 14th December, 2001 and was brought into force in various stages as from 15th July, 2003.  Sellmalta therefore has a legal duty to respect and protect any personal information we collect from you and we will abide by such duty.  We take all safeguards that are necessary to prevent unauthorised access and will not pass on details collected from you as a visitor to any third party or Government entity unless you give us your consent to do so, and unless Sellmalta is compelled to do so by law.  Further information on your data privacy rights are available and can be accessed from the web-site http://www.dataprotection.gov.mt

3. Information Collected

As a visitor, we collect two types of information on you:

• Contact or feedback information;
• Media download / upload information;

3.1 Contact or Feedback Information

When you fill the form on the "CONTACT US" page, we use the personal information submitted in the form only to respond to your message.  This personal information will not be kept longer than necessary and will be deleted once the feedback requirement is met.

Sellmalta is responsible to reply to the feedback form received.  The feedback form should contain the following information:

• Name and Surname,
  
• Email,
  
• Country,
  
• Address and comments.

Failure to enter information relative to the above will result in the form will not being sent.

3.2 Web page Download Information

If you read or download information from our site, we automatically collect and store the following non-personal information:

• Your server address
  
• Your top-level domain name (e.g. .org, .com, .net, .gov, .mt, .uk)
  
• The date and time you visited this site
  
• The pages of this site you accessed, and the documents you downloaded

Our site may contain links to other entities or agencies. In some cases, for the benefit of the visitor, it may be required that we link to other web sites of other organisations after permission is obtained from them respectively.  This privacy policy applies only to www.sellmalta.com. Third party web sites that are linked to or from this site are not covered by this statement. Upon linking to another web site, you are no longer on our web portal and you become subject to the privacy policy of the new web site.  It is therefore advisable to check the privacy policy of the web site in question to determine how your information will be used when visiting that web site.

5. Third-party Information

1. Third parties who have material on this web portal are responsible for ensuring that material(s) and information submitted directly or indirectly for inclusion on this web portal complies with relevant legislation.  The Sellmalta web portal does not guarantee the accuracy of such material and information provided and shall not be responsible for error, omission or inaccuracy in the material or information, misrepresentation and any and all loss, negligence or damage caused by relying on the material and information provided in the web portal, any individual’s disappointment or any failure or alleged failure in the delivery or non-delivery of services provided therein.  The truthfulness of the information and material provided as well as confirmation of the accuracy and currency of such should be sought directly from the advertisers, operators or establishments concerned.  Furthermore any complaints or loss or damage suffered by the user are to be dealt with directly with the advertisers, operators or establishments concerned.  Additionally, any or all information or listing that results to be false and/or misleading shall be promptly removed from the site, and Sellmalta reserves its rights at law for any damages it may suffer as a result of such listings.

This site may contain or refer to trademarks, patents, copyrighted materials, trade secrets, technologies, products, processes or other proprietary rights of Sellmalta and/or third parties.  No license to or right in any such trademarks, patents, copyrighted materials, trade secrets, technologies, products, processes and other proprietary rights of Sellmalta and/or other parties is granted to or conferred upon you

6. Restriction of Usage

This site may provide you with the ability to use usernames, passwords, or other codes or devices to gain access to restricted portions of this site ("access codes").  The content contained in such restricted areas is confidential to Sellmalta, and is provided to you for your business use only. Access codes are non-transferable, and Sellmalta reserves the right to prohibit and/or suspend the use of such access codes on your behalf by third parties at Sellmalta’s discretion, and/or where we determine that such use interferes with our site's operation or results in commercial benefits or other entities to our detriment.

You agree that you will not use any device, software or other instrumentality to interfere or attempt to interfere with the proper working of our site, and that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure.  In addition, you agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained herein, without the prior express consent from an authorised Sellmalta representative (such consent is deemed given for standard search engine technology employed by Internet search web sites to direct Internet users to this site).

7. Photographs

On occasion, Sellmalta representatives may be requested to take photographic images of properties listed on this site.  Such images are subject to the following terms and conditions:

• Sellmalta makes no representations with regards to the images themselves, and the advertiser in question shall remain fully liable for the veracity, authenticity, and content of those photos, including the appearance of any third-party trademarks or other intellectual property rights;
• Photo sessions will only be made according to a pre-scheduled appointment, and at pre-determined charges that are available on request.
• Images taken by Sellmalta in this way, will be uploaded onto the site not before seven (7) days from the date on which they were taken.

9. Cancellation/Return Policy

You may cancel the purchase of a home sales package anytime up to fifteen (15) calendar days after such purchase, by contacting Sellmalta, preferably in writing. Sellmalta shall refund any sums which you may have paid within thirty (30) calendar days.  Sellmalta reserves the right to withhold any bank charges it incurs in connection with the cancelled purchase.
 
For the purposes of this section, the day of conclusion of the contract shall be deemed to be the date of the receipt of payment for the advert space purchased, which date coincides with the automatic enabling of the “my advert” menu icon within your account area.

10. Access to your information

Sellmalta will retain the personal information that it holds on any person or organization until notice requiring removal of such information is given by such person or organisation.  Any person or organization who has registered with this web portal, and who believes that we have gathered and stored personal information relating to them, may request, at any point in time, to view that information.  Any inaccuracies in the information submitted may be corrected and where applicable erased, if deletion has not already taken place.  For the avoidance of doubt, this right to correction shall not apply to the individual entries concerning properties that are advertised on or through this site.

11. Applicable Law & Jurisdiction

This is a Maltese website and is subject to the laws of the Republic of Malta, and all disputes are subject to the exclusive jurisdiction of the Courts of Justice of Malta.
